Klachtenregeling/Office complaints procedure
Artikel 1 begripsbepalingen
1.1 Ortelius Business Law is de naam van het samenwerkingsverband tussen de maatschap Regel en OBL Kelder B.V. Deze juridische entiteiten drijven ieder afzonderlijk een advocatenpraktijk voor eigen rekening en risico. De maatschap Regel bestaat uit de besloten vennootschappen Hazlehead B.V. (mr. O.J. Brommer), Digesta B.V. (mr. M.H. den Otter) en Orphee B.V (mr. J.G.D. Fleers). Binnen de maatschap Regel wordt de advocatenpraktijk voor gezamenlijke rekening en risico gevoerd door de hiervoor genoemde advocaten. Binnen OBL Kelder B.V. voert mr. M.G. Kelder zijn advocatenpraktijk voor eigen rekening en risico. Gezamenlijk treedt dit samenwerkingsverband naar buiten onder de naam Ortelius Business Law.
1.2 In deze kantoorklachtenregeling wordt verstaan onder:
• klacht: iedere schriftelijke uiting van ongenoegen van of namens de cliënt jegens de advocaat of de on-der diens verantwoordelijkheid werkzame personen over de totstandkoming en de uitvoering van een overeenkomst van opdracht, de kwaliteit van de dienstverlening of de hoogte van de declaratie, niet zijnde een klacht als bedoeld in paragraaf 4 van de Advocatenwet;
• klager: de cliënt of diens vertegenwoordiger die een klacht kenbaar maakt;
• klachtenfunctionaris: de advocaat die is belast met de afhandeling van de klacht;
• Ortelius Business Law: het samenwerkingsverband als bedoeld in art. 1.1.
Artikel 2 toepassingsbereik
2.1 Deze kantoorklachtenregeling is van toepassing op iedere overeenkomst van opdracht tussen Ortelius Business Law en de cliënt.
2.2 Ortelius Business Law draagt zorg voor klachtafhandeling conform de kantoorklachtenregeling.
Artikel 3 doelstellingen
3.1 Deze kantoorklachtenregeling heeft tot doel:
• het vastleggen van een procedure om klachten van cliënten binnen een redelijke termijn op een constructieve wijze af te handelen;
• het vastleggen van een procedure om de oorzaken van klachten van cliënten vast te stellen;
• behoud en verbetering van bestaande relaties door middel van goede klachtenbehandeling;
• medewerkers te trainen in cliëntgericht reageren op klachten;
• verbetering van de kwaliteit van de dienstverlening met behulp van klachtbehandeling en klachtanalyse.
Artikel 4 informatie bij aanvang dienstverlening
4.1 Deze kantoorklachtenregeling is openbaar gemaakt. De advocaat wijst de cliënt voor het aangaan van de overeenkomst van opdracht erop dat het kantoor een kantoorklachtenregeling hanteert en dat deze van toe-passing is op de dienstverlening.
4.2 Ortelius Business Law heeft via de algemene voorwaarden opgenomen bij welke onafhankelijke partij of instantie een klacht die na behandeling niet is opgelost kan worden voorgelegd ter verkrijging van een bin-dende uitspraak en heeft dit bij de opdrachtbevestiging kenbaar gemaakt.
4.3 Klachten als bedoeld in artikel 1 van deze kantoorklachtenregeling die na behandeling niet zijn opgelost worden voorgelegd aan bevoegde rechter in van de rechtbank Zeeland – West-Brabant, locatie Breda.
Artikel 5 interne klachtprocedure
5.1 Indien een cliënt het kantoor benadert met een klacht, dan wordt de klacht doorgeleid naar mr. J.G.D. Fleers, die daarmee optreedt als klachtenfunctionaris.
5.2 De klachtenfunctionaris stelt degene over wie is geklaagd in kennis van het indienen van de klacht en stelt de klager en degene over wie is geklaagd in de gelegenheid een toelichting te geven op de klacht.
5.3 Degene over wie is geklaagd, tracht samen met de cliënt tot een oplossing te komen al dan niet na tussenkomst van de klachtenfunctionaris.
5.4 De klachtenfunctionaris handelt de klacht af binnen vier weken na ontvangst van de klacht of doet met opgave van redenen mededeling aan de klager over afwijking van deze termijn met vermelding van de termijn waarbinnen wel een oordeel over de klacht wordt gegeven.
5.5 De klachtenfunctionaris stelt de klager en degene over wie is geklaagd schriftelijk op de hoogte van het oordeel over de gegrondheid van de klacht, al dan niet vergezeld van aanbevelingen.
5.6 Indien de klacht naar tevredenheid is afgehandeld, tekenen de klager, de klachtenfunctionaris en degene over wie is geklaagd het oordeel over de gegrondheid van de klacht.
Artikel 6 geheimhouding en kosteloze klachtbehandeling
6.1 De klachtenfunctionaris en degene over wie is geklaagd nemen bij de klachtbehandeling geheimhouding in acht.
6.2 De klager is geen vergoeding verschuldigd voor de kosten van de behandeling van de klacht.
Artikel 7 verantwoordelijkheden
7.1 De klachtenfunctionaris is verantwoordelijk voor de tijdige afhandeling van de klacht.
7.2 Degene over wie is geklaagd houdt de klachtenfunctionaris op de hoogte over eventueel contact en een mogelijke oplossing.
7.3 De klachtenfunctionaris houdt de klager op de hoogte over de afhandeling van de klacht.
7.4 De klachtenfunctionaris houdt het klachtdossier bij.
Artikel 8 klachtregistratie
8.1 De klachtenfunctionaris registreert de klacht met daarbij het klachtonderwerp.
8.2 Een klacht kan in meerdere onderwerpen worden ingedeeld.
8.3 De klachtenfunctionaris brengt periodiek verslag uit over de afhandeling van de klachten en doet aanbevelingen ter voorkoming van nieuwe klachten, alsmede ter verbetering van procedures.
8.4 Minimaal eenmaal per jaar wordt de verslagen en de aanbevelingen besproken en ter besluitvorming voorgelegd aan de samenwerking Ortelius Business Law.
Article 1 – Definitions
1.1 Ortelius Business Law is the name of the partnership arrangement (samenwerkingsverband) between the professional partnership (maatschap) Regel and OBL Kelder B.V. Each of these legal entities separately conducts a law practice for its own account and at its own risk. The professional partnership Regel consists of the private limited liability companies (besloten vennootschappen) Hazlehead B.V. (O.J. Brommer), Digesta B.V. (M.H. den Otter), and Orphee B.V. (J.G.D. Fleers). Within the professional partnership Regel, the attorneys (advocaten) named above conduct their law practice for joint account and at joint risk. Within OBL Kelder B.V., M.G. Kelder conducts his law practice for his own account and at his own risk. Together, these entities operate under the name Ortelius Business Law.
1.2 In this office complaints procedure, the following terms have the following meanings:
• complaint (klacht): any written expression of dissatisfaction by or on behalf of the client directed at the attorney (advocaat) or at persons working under the attorney’s responsibility, concerning the formation or performance of a contract for services (overeenkomst van opdracht), the quality of the services, or the amount of an invoice (declaratie), other than a complaint within the meaning of Section 4 (paragraaf 4) of the Act on Advocates (Advocatenwet);
• complainant (klager): the client, or the client’s representative, who submits a complaint;
• complaints officer (klachtenfunctionaris): the attorney charged with handling the complaint;
• Ortelius Business Law: the partnership arrangement (samenwerkingsverband) as defined under art. 1.1. above.
Article 2 – Scope
2.1 This office complaints procedure applies to every contract for services between Ortelius Business Law and the client.
2.2 Ortelius Business Law ensures that complaints are handled in accordance with this office complaints procedure.
Article 3 – Objectives
3.1 The objectives of this office complaints procedure are:
• to establish a procedure for handling client complaints constructively and within a reasonable period;
• to establish a procedure for identifying the causes of client complaints;
• to maintain and improve existing client relationships through proper complaint handling;
• to train staff to respond to complaints in a client-focused manner;
• to improve the quality of our services through complaint handling and complaint analysis.
Article 4 – Information at the start of the engagement
4.1 This office complaints procedure has been made public. Before entering into a contract for services, the attorney informs the client that Ortelius Business Law applies an office complaints procedure and that it applies to the services provided.
4.2 In its general terms and conditions, Ortelius Business Law has specified the independent party or body to which a complaint that has not been resolved after being handled may be submitted to obtain a binding decision and has communicated this in the engagement letter (opdrachtbevestiging).
4.3 Complaints within the meaning of Article 1 of this office complaints procedure that have not been resolved after being handled are submitted to the competent court of the District Court of Midden-Nederland (rechtbank Midden-Nederland), sitting in Utrecht.
Article 5 – Internal complaints procedure
5.1 If a client approaches Ortelius Business Law with a complaint, the complaint is referred to J.G.D. Fleers, who thereby acts as complaints officer.
5.2 The complaints officer notifies the person about whom the complaint has been made that a complaint has been submitted and gives both the complainant and that person the opportunity to comment on the complaint.
5.3 The person about whom the complaint has been made seeks to reach a solution with the client, whether with the involvement of the complaints officer.
5.4 The complaints officer handles the complaint within four weeks of receipt or, stating the reasons, notifies the complainant of any deviation from this period and of the period within which a decision on the complaint will be given.
5.5 The complaints officer notifies the complainant and the person about whom the complaint has been made in writing about the decision on the merits (gegrondheid) of the complaint, with or without recommendations.eeland – West BrabvantIf the complaint has been handled to the complainant’s satisfaction, the complainant, the complaints officer, and the person about whom the complaint has been made sign the decision on the merits of the complaint.
Article 6 – Confidentiality and free complaint handling
6.1 The complaints officer and the person about whom the complaint has been made observe confidentiality (geheimhouding) in handling the complaint.
6.2 The complainant owes no fee for the costs of handling the complaint.
Article 7 – Responsibilities
7.1 The complaints officer is responsible for handling the complaint in a timely manner.
7.2 The person about whom the complaint has been made keeps the complaints officer informed of any contact with the complainant and of any possible solution.
7.3 The complaints officer keeps the complainant informed of the handling of the complaint.
7.4 The complaints officer maintains the complaint file.
Article 8 – Registration of complaints
8.1 The complaints officer registers the complaint together with its subject matter.
8.2 A complaint may be classified under more than one subject.
8.3 The complaints officer reports periodically on the handling of complaints and makes recommendations for preventing new complaints and improving procedures.
8.4 At least once a year, the reports and recommendations are discussed and submitted to the partnership arrangement Ortelius Business Law for decision making.
